La CRIA (Canadian Creator and Music Industry Groups) ha avuto da dire la sua su Demonoid ed altri Motori di Ricerca Torrents, ora hanno messo gli occhi su IsoHunt, uno dei più grandi Motori di Ricerca Torrents e la battaglia potrebbe fallire, questo perchè il noto motore di ricerca li ha citati in Giudizio.
isoHunt ha ricevuto in Maggio un “Cease and Desist” dal CRIA in cui chiedevano al fondatore Gary Fung di mettere il sito offline. Qualora Fung non avesse aderito alla richiesta, il CRIA minacciava azioni legali e che avrebbe chiesto 20.000 $ ad ogni infrazione.
TorrentFreak informa che la stessa tattica utilizzata per IsoHunt è stata adottata anche con Demonoid ma il fondatore di IsoHunt non l’ha per niente “digerita” “We have since tried to come to an understanding, but just as with the MPAA in the US, they ignored our offers of cooperation by the take down of .torrent links to their content files, so long as they provide sufficient identification”.
Fung precisa che a differenza di altri Motori di Ricerca Torrents IsoHunt ha una politica del copyright e elimina i torrent di cui è stato richiesto il shutdown. Il CRIA ha ignorato la politica di IsoHunt nonostante abbiano effettuato qualche richiesta di TakeDown ed ora minacciano di proseguire per via legale.
Fung ha deciso di citare la CRIA come atto di autodifesa specificando alla Corte che anche Torrentbox e Podtropolis non infrangono il copyright:
“This is our preemptive strike with a narrowly defined petition for Declaratory Relief that we do not infringe, in anticipation they are going to file their own lawsuit that we do infringe (their copyright)” “Our petition summarizes BitTorrent technology, its open nature and a whole ecosystem of websites and operators that has developed around it, that CRIA does not own copyright to all files distributed over BitTorrent or on isoHunt websites, and we seek legal validation that we can continue to innovate within this emerging BitTorrent ecosystem on the Internet.”
Fung rivela durante la chiaccherata con TorrentFreak che hanno l’intenzione, se necessario, di arrivare fino alla Corte Suprema Canadese ma anche che ci sono alcuni partiti nel Canada che stanno dalla loro parte sebbene non possa svelare chi siano …
“Think of this as a follow up to the QuebecTorrent case,” “We intend to take this all the way up to the Canadian Supreme Court unless CRIA settles with us out of court in any reasonable way,” “There are some interesting parties in Canada in our camp I’m not disclosing yet, this is going to make an interesting case and the most important copyright case in Canada currently.”
Ci troviamo dinanzi al primo caso mondiale in cui viene chiesto ad una corte di decidere se i files torrent e più in particolare i Motori di Ricerca Torrents infranfono la legge, isoHunt dalla sua si considera come un semplice motore di ricerca come Google senza il controllo dei files che si trovano sul Web.
