Baidu, il motore di ricerca Cinese veniva citato in giudizio nel lontano 2008 da Sony BMG, Universal Music e Warner Music poichè forniva “deep links” a tracce musicali coperte da Copyright. La Corte ha emesso una sentenza in cui afferma che Baidu non viola il Copyright
Baidu è il primo motore di ricerca Cinese, ne abbiamo sentito parlare negli ultimi giorni (settimane) visto il tentativo di hacking portato avanti dalla ‘Iranian cyber army’, la stessa organizzazione che portò l’anno scorso Twitter offline. Sono riconosciute mondialmente “le funzionalità di ricerca mp3″ di Baidu, il proprio algoritmo è in grado di fornire milioni di links a files mp3 ospitati dai siti web (deep linking). Baidu ha sempre insistito che tale servizio non viola il copyright. La IFPI (International Federation of the Phonographic Industry), accusava nel 2008 Baidu, il motore di ricerca Cinese dicendo che tale pratica è invece illegale. Nel lontano 2008 John Kennedy, Chairman e Chief Executive di IFPI diceva:
“We are disappointed that the court did not find Baidu liable, but that judgment was about Baidu’s actions in the past under an old law that is no longer in force. The judgment is irrelevant since it has effectively been superseded by the Yahoo China ruling. Baidu should now prepare to have its actions judged under the new law. We are confident a court would hold Baidu liable as it has Yahoo China.”
Spinti da una vecchia sentenza contro Yahoo Cina, John Kennedy dichiarava guerra a Baidu. IFPI (Sony BMG, Universal Music e Warner Music) citò in giudizio nel 2008 Baidu per 9 milioni di $. Quest’oggi possiamo leggere finalmente l’esito della sentenza, il Deep Linking è legale e a IFPI rimane il solo spazio sul proprio portale per dichiarare il deep linking illegale in Cina.
